Terms of Service

By accessing or using Plan by Price ("we," "our," or "us"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our application.

1. Description of Service

Plan by Price is a software tool designed to generate budget-optimized travel itineraries. We utilize algorithmic sorting and third-party APIs to suggest activities and estimate costs. We do not guarantee the availability, exact pricing, or quality of any suggested activity, as these factors are controlled by third-party vendors and are subject to real-time market fluctuations.

2. Affiliate & Booking Disclaimer

We partner with third-party providers to source live activity and attraction data. Links to book these activities may include affiliate tracking codes, meaning we may earn a commission if you make a purchase.

Important: We are not a travel agency or tour operator. We are not responsible for cancellations, injuries, refunds, or disputes regarding any tour, activity, or localized booking sourced through our external partners. All transactions occur on the third-party provider's platform, governed by their respective terms and conditions.

3. User Accounts & Security

To save itineraries or access premium features, you must provide a valid email address for authentication. You are responsible for maintaining the security of your login credentials (such as magic links or codes sent to your email). You agree not to share your account access with third parties.

4. Payments & Refund Policy

Certain features of the application may require a paid subscription or a one-time purchase. All payments are securely processed by our authorized, PCI-compliant Merchant of Record. To ensure fairness while managing the costs of our real-time algorithms, our refund policy depends on the type of purchase:

Recurring Subscriptions: We want you to feel confident trying our premium features. If you purchase a monthly or yearly subscription, you are eligible for a full refund if you meet both of the following criteria:

• You request the refund within 72 hours (3 days) of your initial purchase.
• You have clicked to "Generate" three (3) or fewer itineraries since the purchase.

Note: Our system logs itinerary generation requests to properly manage API limits. Deleting a saved itinerary from your dashboard does not reverse this generation count.

One-Time Purchases (Consumables): Because single-use packs (like weekend bundles) are standalone digital goods that require immediate processing, these purchases are final and non-refundable once the transaction is complete.

If you ever experience a technical failure or an accidental duplicate charge, please reach out to support so we can make it right.

5. Acceptable Use & API Abuse

You agree to use Plan by Price solely for personal or intended business planning. You strictly agree NOT to:

• Use automated scripts, bots, or scrapers to access the service, extract data, or bypass our UI.
• Intentionally spam, overload, or exhaust our API endpoints or third-party integrations (Denial of Wallet attacks).
• Attempt to bypass rate limits, paywalls, or authentication mechanisms.

We employ automated edge security and Redis-backed rate limiting. We reserve the right to instantly terminate or permanently ban any IP address or user account caught attempting to abuse the system, without notice or refund.

6. Intellectual Property

The design, source code, branding, and proprietary sorting algorithms of Plan by Price are our exclusive property. You may not copy, reverse-engineer, or redistribute any part of our application without explicit written permission. You retain ownership of the specific local and travel itineraries you generate and save to your account.

7. Limitation of Liability

To the maximum extent permitted by law, Plan by Price and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or travel expenses, resulting from your use of the service. The service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind.

8. Governing Law & Jurisdiction

These Terms of Service shall be governed by and construed in accordance with the laws of the Province of Newfoundland and Labrador, and the federal laws of Canada applicable therein, without regard to its conflict of law provisions. Any legal actions or proceedings arising out of these terms shall be brought exclusively in the courts located in St. John's, Newfoundland and Labrador.

9. Modifications to Terms

We reserve the right to modify these terms at any time. Continued use of the service after such modifications constitutes your acknowledgement and acceptance of the updated terms.
